General Terms and Conditions of Purchase 
for Resellers of MARIA ÅKERBERG


General

These terms and conditions constitute an integrated part of all orders regarding the purchase of Products (as defined below) from MARIA ÅKERBERG AB, corporate identity number 556622-6444 (hereinafter referred to below as MARIA ÅKERBERG). When a Reseller (as defined below) has approved these conditions via MARIA ÅKERBERG’s web shop or otherwise orders Products from MARIA ÅKERBERG, the conditions shall constitute the agreement between the parties for the Reseller’s purchase of Products from MARIA ÅKERBERG and regulates the conditions that the Reseller must adhere to as a reseller of Products (the “Agreement”).


The terms and conditions set out herein shall also be applied to any and all complementary orders from Resellers, even if these terms and conditions are not referred to in the specific order or in the order confirmation provided by MARIA ÅKERBERG. If the Reseller has specified other terms in an order confirmation, an order, other similar documents or otherwise referred to other terms that contradict these terms and conditions, these terms and conditions shall prevail regardless of whether MARIA ÅKERBERG has previously objected to the Reseller’s terms or not.


A reseller that wishes to purchase Products from MARIA ÅKERBERG shall apply via MARIA ÅKERBERG’s website to become a reseller of Products (described below). MARIA ÅKERBERG shall have the right to, at its sole discretion, approve or reject such application. Resellers approved by MARIA ÅKERBERG that fulfil the regulations and requirements of this Agreement shall be resellers (“Resellers”). When the Reseller has been approved by MARIA ÅKERBERG the Reseller may order Products via MARIA ÅKERBERG’s website. Only Resellers are entitled to order Products from MARIA ÅKERBERG and to act as resellers for the brand MARIA ÅKERBERG. 

A Reseller is only entitled to actively sell Products from MARIA ÅKERBERG AB in the country where the Reseller has its principal place of business. The sale of Products from MARIA ÅKERBERG AB shall take place in the Reseller’s salon to consumers and companies that do not intend to sell the Products further and act as resellers (“Final Consumer”). All Resellers must be registered with and acquire authorization from MARIA ÅKERBERG.

The Reseller has the right to purchase and sell further Products from the brand MARIA ÅKERBERG that MARIA ÅKERBERG, from time to time, advertises (the “Products”). The Products included in the Reseller’s right inter alia depends on the Reseller’s level of training.

When ordering products from MARIA ÅKERBERG by phone or e-mail. Always state your customer number. That does not have to be done when placing orders online as you then must log in. When asking questions regarding your order, always state the order number or invoice number.


Pure Cell Roseroot, that can be purchased by Resellers that have attended Pure Cell Education and use the stem cells in Pure Cell Treatment, are only being shipped from our warehouse on Mondays, Tuesdays and Wednesdays. The reason is that the stem cells need to be stored in cool temperatures and we do not want to risk their survival if placed in storage by freight companies over the weekend. Orders containing cells that are received later than Wednesday at noon will therefore be shipped the upcoming week.



Customer Club – our way of giving you free tester products
Every Reseller who places an order in our web shop, partner.mariaakerberg,com, receives points that can then be exchanged for tester products. The Reseller chooses which products to purchase as testers. As a Reseller, you get 1 point for every SEK spent. When placing an order, 1,000 points correspond to a 50 SEK discount on the next order. Points can be saved to order more free testers, but the points are reset at the end of each year. The more a Reseller purchases, the more testers/products can be ordered free of charge. 1,000 SEK generates 1,000 points, which in turn creates a discount voucher of 50 SEK that can be used on the next order. At checkout, the Reseller will be able to see if there are vouchers to redeem. If the Reseller has several vouchers, they can choose to use them all at the same time or divide them between different orders. NB! The points will only be good to spend in the same calendar year as they have been acquired. They will expire on December 31 each year!

1. Price

The Reseller shall pay the price communicated by MARIA ÅKERBERG from time to time or that appear from MARIA ÅKERBERG’s web shop for Resellers. The prices stated are excluding value-added tax (VAT). MARIA ÅKERBERG reserves the right to adjust prices due to change in suppliers, changes in currency exchange prices or changes in governmental tax duties.


Norway
Orders are delivered by UPS. Free shipping applies to all orders with a value of 5,000 SEK or above. Orders can be placed via web shop, telephone or e-mail. If the value of an order is less than 5,000 SEK, the actual shipping cost as well as import duties will be charged retroactively. Import duties are paid to UPS directly.


Upon delay with payment, MARIA ÅKERBERG is entitled to a yearly interest on overdue payment of twelve percent (12 %) on the delayed payment. MARIA ÅKERBERG also has the right, after notifying the Reseller in writing, to suspend its fulfilment of the Agreement until payment is made.

2. Minimum orders

As a skin and spa therapist, it is required that the first order is of at least SEK 10,000 excluding VAT for retail products. Professional products are in addition to these. To be able to continue to purchase products from MARIA ÅKERBERG at Reseller prices, a minimum purchase of SEK 10,000 excluding VAT per calendar year is required.

As a massage therapist, podiatrist or other type of therapist, it is required that the first order is at least SEK 3,000 excluding VAT of retail products. Professional products are in addition to these. To be able to continue to purchase products from MARIA ÅKERBERG at Reseller prices, a minimum purchase of SEK 3,000 excluding VAT per calendar year is required.

 

Som massageterapeut, fotterapeut eller annan typ av terapeut krävs det att den första beställningen är på minst 3 000 SEK exkl. moms av konsumentprodukter. Professionella produkter tillkommer utöver dessa. För att fortsatt kunna köpa in produkter från MARIA ÅKERBERG till Återförsäljarpris krävs ett minimiinköp om 3 000 SEK exkl. moms per kalenderår. 

3. Payment

Invoice
Products from MARIA ÅKERBERG are invoiced with 30 days payment terms (if the Reseller qualifies for that). If payment is not received by MARIA ÅKERBERG within the 30 days, interest may be charged on the past due invoices (or interest can be added to the next invoice) and the Reseller will lose the credit. Prepayment will be required on a first order and if a credit check recommends it.

4. Delivery Information

Shipping

Norway
Orders are delivered by UPS. Free shipping applies to all orders with a value of 5,000 SEK or above. Orders can be placed via web shop, telephone or e-mail. If the value of an order is less than 5,000 SEK, the actual shipping cost as well as import duties will be charged retroactively. Import duties are paid to UPS directly.
 


Norway
Orders are delivered by UPS. Free shipping applies to all orders with a value of 5,000 SEK or above. Orders can be placed via web shop, telephone or e-mail. If the value of an order is less than 5,000 SEK, the actual shipping cost as well as import duties will be charged retroactively. Import duties are paid to UPS directly.


Within the EU but outside of the Nordic countries
Orders within the EU but outside of the Nordic countries will be delivered by UPS. Free shipping applies to all orders with a value of at least 5,000 SEK (or € 475). Orders can be placed via web shop, telephone or e-mail. If the value of an order is less than 5,000 SEK (or € 475), a shipping fee of € 35,50 will be charged. Import duties are paid to UPS directly. 


Outside of the fiscal territory of the EU
International orders (outside of the EU, not Norway) will be delivered by UPS. Free shipping applies to all orders with a value of at least 10,000 SEK. Orders can be placed via web shop, telephone or e-mail. If the value is less than 10,000 SEK, the actual shipping cost will be charged retroactively. Import duties are paid to UPS directly.

Delivery times
Deliveries within Sweden normally take between 5-7 business days. Deliveries outside of Sweden but within the EU normally takes between 5-10 business days. When a package leaves MARIA ÅKERBERG, a notification is sent by e-mail to the Reseller. 

All delivery times communicated by MARIA ÅKERBERG are preliminary estimates. MARIA ÅKERBERG cannot be held responsible in case delivery is made after the communicated day or time for delivery.


Package tracking
MARIA ÅKERBERG is currently working with unifaun.se. This means that MARIA ÅKERBERG will send an e-mail, as a pre-delivery notification for each shipment when the package leaves MARIA ÅKERBERG. Here, the Reseller can track the package via a link and see where it is located using the package ID.


Return of a delivery
If a Reseller is not available when an order is delivered, or if an order has not been collected from a postal agent, so that the order must be shipped back to us and then redelivered, a fee of 250 SEK will be charged. This fee includes shipping charges, return charges as well as handling. 


Company background

Since its inception in 1995, Final Consumer satisfaction has always been one of MARIA ÅKERBERG’s primary goals. This goal has been achieved by offering Final Consumers expert knowledge and products that meet their specific personal needs. This requires therapists with a high level of expertise and therefore high demands are placed on MARIA ÅKERBERG’s Resellers. The purpose of this Agreement is to clarify what conditions apply when selling via salon.


1. Obligation to honour the brand of MARIA ÅKERBERG etc.

The Reseller shall allegiantly, vigorously and in the best way honour the brand MARIA ÅKERBERG, its reputation as well as products and the sales of these to Final Consumers.  


The reseller shall institute required measurements to ensure acute levels of customer service, customer satisfaction and that the guidance given to Final Consumers is adequate, individualized and is according to the directions and recommendations that have been given by MARIA ÅKERBERG. 


2. Marketing

The Reseller shall in their marketing and sales of Products from MARIA ÅKERBERG comply with the current guidelines and directions, as stated in Appendix 1. 


Marketing material regarding the Products, that has been designed by the Reseller, shall be approved by MARIA ÅKERBERG before publishing.


Expenses incurred for marketing campaign shall be expensed, unless agreed otherwise, by the party that is arranging the marketing activity. 


3. Requirements for training

When a prospective Reseller places their first order, they will be booked to attend the next MÅ Basic Product Training.


The compulsory training for Skincare- and Spa Therapists covers the following:
Step 1 Basic Product Training – Skincare- and Spa Therapists
Step 2 Cosmetic Chemistry (to be completed no later than the second year as a Reseller)
Step 3 Skin Diseases (to be completed no later than the second year as a Reseller)
All courses must be completed within 2 years of becoming a Reseller.


Compulsory training for Massage Therapists, Foot Care Therapists, Hairdressers and Makeup Artists:
Step 1 Basic Product Training - Massage Therapists, Foot Care Therapists, Hairdressers and Makeup Artists.


The training requirements may be updated by MARIA ÅKERBERG. As a prerequisite, Resellers must, at all times, fulfil the applicable training requirements to be able to sell products from MARIA ÅKERBERG. MARIA ÅKERBERG has the right to ensure that the Reseller fulfils the training requirements. If the training requirements are not fulfilled, MARIA ÅKERBERG has the right to revoke the Reseller’s registration as Reseller and to terminate the Agreement in accordance with section 14 (b). 


Products from MARIA ÅKERBERG can be sold in a Reseller’s web shop six (6) months after first order and six (6) months after completed Basic Product Training the earliest.


4. Personal contact with trained therapist

The Reseller shall on their website (if one is available) state the name and contact details of the responsible, adequately trained professional therapist who is available to offer customer advice with respect to the product range for sale. The level of training and certifications/completed courses for the therapist/therapists must also be clearly stated.


The Reseller must ensure that Final Consumers who shop at the salon receive a personal contact with the professional therapist on site who offers expert advice in relation to the customer’s skin type, skin problems etc. Depending on the product range and treatments offered at the salon, the assigned professional may either be a Skin Therapist, Spa Therapist, Massage Therapist or Foot Care Therapist. A distinctive characteristic that MARIA ÅKERBERG is a professional skincare brand is the direct contact between the Final Consumer and Therapist. First-time contact should always include a skin analysis at the salon. If other arrangements are necessary, they must be authorised in writing by MARIA ÅKERBERG.


5. Requirements for operating a salon

A highly prioritised requirement when selling Products from MARIA ÅKERBERG is that the Reseller actively offers treatments and the sale of Products. Opening hours, visiting address and what treatments are offered with Products from MARIA ÅKERBERG must be clearly stated on the Reseller’s website (if one is available). Opening hours must also be available in connection to the Reseller’s premises.
 


6. Laws and regulations

The Reseller must comply with the laws and regulations that apply to the market in which he/she operates. The Reseller has the right to sell Products from MARIA ÅKERBERG once the basic requirements are met, such as training requirements. The Reseller hereby undertakes not to be an agent for or hold wholesale operations for another skincare brand.


7. Company information

On the website (if one is available), the Reseller's full name and legal person must be clearly stated, as well as the corporate identity number, street address, e-mail and phone number that a Final Consumer can contact for support and assistance with complaints.


8. The Products – Shelf-life

Products from MARIA ÅKERBERG, sold to Final Consumers, must have at least six (6) months shelf-life when sold. When having products with shorter dates, they can be sold at a discounted price and the Final Consumer shall be informed.


9. Updating marketing material

It is the responsibility of the Reseller to ensure that leaflets, catalogues, posters, etc. are regularly kept up-to-date.


10. Campaigns from MARIA ÅKERBERG

When MARIA ÅKERBERG creates a central product offer (campaign) intended to be offered to the market for a limited time, the following applies to all Resellers that choose to take part in the campaign:

- Products purchased at the campaign price can only be offered from the date that MARIA ÅKERBERG has determined to be the start date of the campaign. 

- Products purchased at the campaign price cannot, during the campaign period, be offered at a higher price than the price that has been determined by MARIA ÅKERBERG. 

- Products purchased at the campaign price shall after the campaign period be offered at the Reseller’s ordinary price for at least two weeks. If the campaign consists of a set of products, then the set shall be sold at the combined ordinary price of the products. 

- MARIA ÅKERBERG only, the owner of the campaign, may change these restrictions. In order to enjoy special offers and campaigns from MARIA ÅKERBERG, it is necessary to observe all above restrictions. Resellers who do not comply with the terms of the special offer will not be eligible to purchase the next special offers at a discounted price.


11. Right to assistance and complaints

Final Consumers must always contact the Reseller directly for assistance with complaints, withdrawal rights and other issues relating to the purchase or order. The Reseller is responsible for providing this information to his or her customers and handling the above without the involvement of MARIA ÅKERBERG. The Reseller must be able to provide customer support during the specified times stated on their website. Customer support is provided online, by e-mail or phone and responses must be provided within a reasonable time (normally within 48 hours).


12. Right of withdrawal and other rights of the Final Consumer

The Reseller is obliged, in relation to the Final Consumer, to comply with applicable laws and regulations and to respect the rights that may apply to Final Consumers in the country where the Reseller is active.


The Final Consumer must be informed of what conditions apply to any withdrawal rights and where to turn for assistance in such matters. The Reseller undertakes to follow the recommendations of the accountable authority within the country he or she operates in, in regard to any withdrawal rights.


Should a product be defective, the Final Consumer should be able to file a complaint and receive money and postage back. In order for MARIA ÅKERBERG to be able to replace a defective Product, at least half of the content must be remaining, and the Reseller must notify MARIA ÅKERBERG of the complaint within 30 days from the receipt of notice to the Reseller by the Final Consumer.


If the Final Consumer has used the Product and is dissatisfied with the scent, effect, colour, is allergic or for any other reason no longer wants the Product, no right of withdrawal shall apply unless otherwise stipulated by mandatory legislation. For most Products, samples should be offered to uncertain Final Consumers. The same applies if the Final Consumer has hypersensitive skin. The recommendation shall always be that the Final Consumer initially tries the Product on a small surface of the skin to see whether they have a reaction to the Product or not.


13. Product range

MARIA ÅKERBERG offers both retail products for home use and professional salon products. Which retail products a Reseller may sell depends on the level of training. Professional salon products may not be sold to Final Consumers. The product range the Reseller may offer to Final Consumer cannot be changed or updated without the approval of MARIA ÅKERBERG.


14. Duration and termination of the Agreement

This Agreement shall enter into force when 1) it has been approved by the Reseller via MARIA ÅKERBERG’s website in connection with the application to become an authorised reseller, 2) MARIA ÅKERBERG has approved the applicant as a Reseller and 3) the Reseller makes its first order of Products from MARIA ÅKERBERG via MARIA ÅKERBERG’s web shop. The Agreement shall be applicable as long as the Reseller makes sales of Products to Final Consumers.


If the Reseller provides notice, in writing, that he or she has ceased sales of Products to Final Consumers, this Agreement shall be terminated with immediate effect without prior notice. The Agreement shall also be terminated without prior notification if the Reseller has not purchased Products during a consecutive period of twelve (12) months.


Either party may terminate this Agreement with immediate effect or to take effect on the day the terminating party chooses if:

a) the other party to a significant extent has failed to fulfil its obligations under this Agreement; or

b) the other party has failed to fulfil its obligations under this Agreement and the failure has not been cured within thirty (30) days of receiving written notification (including a statement on the breach of contract and with reference to this section) from the terminating party, if the breach of contract is possible to cure; or

c) the other party should be declared bankrupt, initiate a reconstruction, make a composition with its creditors or otherwise become insolvent.

MARIA ÅKERBERG has the right to terminate this Agreement with immediate effect or to take effect on the day MARIA ÅKERBERG chooses if the Reseller does not honour the brand MARIA ÅKERBERG in the ways required by this agreement, is subject to major changes in ownership or management, which affect the justified interests of MARIA ÅKERBERG or if the Reseller should come under the direct or indirect direction or control of any person, legal or individual, who MARIA ÅKERBERG cannot, in MARIA ÅKERBERG’s sole opinion, accept as an indirect party to this Agreement.

For the cases when a premature notice of termination of the agreement does not exist, the agreement will proceed with a term of notice of six (6) months from MARIA ÅKERBERG. 

Termination shall always be made in writing and without undue delay after the terminating party has become aware of the circumstances invoked as grounds for termination.

Approval of this Agreement confirms that the Reseller has read, understood and accepted the terms and conditions.

15. Consequences of termination

Obligations that expressly or by their nature shall survive the termination of this Agreement shall do so.


Upon termination of the Agreement, regardless of the reason, MARIA ÅKERBERG shall recall the Reseller’s registration as reseller of the Products. If the Reseller subsequently wishes to reregister as a reseller, the Reseller shall apply for this via MARIA ÅKERBERG’s website.


In case MARIA ÅKERBERG has issued an order confirmation before the termination of the Agreement, the parties are obliged to fulfil such order unless the Agreement has been terminated with immediate effect in accordance with section 14. 


Upon termination of the Agreement, regardless of the reason, the Reseller shall immediately cease the use of MARIA ÅKERBERG’s trademarks or brands on their website or otherwise.


16. Confidentiality

The parties undertake not to, during the term of the Agreement and thereafter, without the other party’s prior written approval, disclose or reveal any information (regardless of whether it is in oral, written, electronic or other form) about the other party’s operations that may be considered a trade or professional secret or otherwise use such information for any purpose other than for party’s fulfilment of their obligations under this Agreement. Information that a party has declared to be confidential shall at all times be considered a trade or professional secret.


This confidentiality undertaking shall not apply to information that party can prove they learned of in a manner other than through this Agreement or which is public knowledge. Nor does this confidentiality undertaking apply when a party is required to disclose information in accordance with any law, enactment or decision by governmental authorities.


17. Personal Data

MARIA ÅKERBERG and the service providers that process personal data on behalf of MARIA ÅKERBERG, so-called personal data processors, will process the Reseller’s or the Reseller’s representative’s personal data in accordance with EU’s General Data Protection Regulation and other applicable laws.

18. Providing notice and defective Products

Damages to outer packaging
If the Reseller discovers that the outer packaging is damaged in such a way that the Products likely are damaged as well, the Reseller shall not accept the shipment but instead return it to MARIA ÅKERBERG.

Complaints of defects
MARIA ÅKERBERG must be put on notice by the Reseller of all remarks of defects to a delivery which can or could have been noticed at receipt inspection, within five (5) business days after the Reseller is in receipt of the shipment. The Reseller may not put MARIA ÅKERBERG on notice with respect to damaged or missing Products after five (5) business days from the Reseller’s receipt of the shipment. The Reseller shall always contact MARIA ÅKERBERG before putting MARIA ÅKERBERG on notice about defective Products.

A Product from MARIA ÅKERBERG is defective only if its packaging or content significantly deviates from a product specification produced by MARIA ÅKERBERG. MARIA ÅKERBERG does not guarantee specific results from the use of the Products. Should a Product be defective, MARIA ÅKERBERG shall deliver a new Product at the company’s own expense. The Reseller’s sole remedy against MARIA ÅKERBERG in case of a defective delivery shall be delivery of substitute goods. A defect in a Product which has not and should not have been noticed at a receipt inspection must be put on notice to MARIA ÅKERBERG at the latest two (2) years after the day the Product was delivered to the Reseller.

The Reseller may not return non-defective Products without prior approval from MARIA ÅKERBERG.

19. Intellectual Property Rights

MARIA ÅKERBERG owns the rights to all material such as texts, files, photographs, graphics and other material that is provided by MARIA ÅKERBERG or otherwise is attributable to the Products. 


All intellectual property rights, including MARIA ÅKERBERG’s trademark (including MARIA ÅKERBERG), trade name, and domain name or otherwise in or attributable to the Products are the property of MARIA ÅKERBERG. A purchase through MARIA ÅKERBERG’s web shop does not entail a transfer of the rights to this property to the Reseller. The Reseller’s use of MARIA ÅKERBERG’s trademark or other material attributable to the Products shall always comply with the instructions provided by MARIA ÅKERBERG from time to time.


20. Students

As a registered student at an approved school, MARIA ÅKERBERG will consider the student a trial Reseller. MARIA ÅKERBERG requires under such circumstances prepayment and a submitted application to become a MARIA ÅKERBERG trial Reseller. The advantage of this is that he or she will receive access to the same favourable agreements as existing, authorised Resellers during the time of attending school.

Should a student wish to become a Reseller once the training is completed, a diploma and VAT certificate must be submitted to MARIA ÅKERBERG in order for the agreement to be changed.​


21. Miscellaneous

MARIA ÅKERBERG reserves the right to change the terms and conditions of this Agreement. The terms and conditions applicable at the time of an order shall apply to that specific purchase.

MARIA ÅKERBERG is under no circumstances liable for special, temporary, indirect or financial damages or consequential damages, such as loss of profits or revenue, whether achieved or calculated, for non-use of the Products.  


This Agreement constitutes the entire agreement between the parties on all issues to which the Agreement relates. The contents of this Agreement supersede all previous written or oral commitments and undertakings.


If any provision of this Agreement or part thereof, shall to any extent be or become, invalid or unenforceable, the remainder of this Agreement shall not be affected thereby, and any other provision of this Agreement shall be valid and enforceable to the fullest extent.


22. Applicable law and disputes

This Agreement shall be governed by and construed in accordance with Swedish material law. Any dispute, controversy or claim arising out of or in connection with this Agreement shall at first instance be settled by the District Court of Gothenburg, Sweden.


Special terms and conditions - web shop

The Reseller is only entitled to sell products from MARIA ÅKERBERG on the market of the Reseller’s principal place of business. The Agreement concerns the sale of Products from MARIA ÅKERBERG at their salon and in their web shop. The Reseller is 100% responsible for the installation, operation and maintenance of the web shop. This also includes deliveries and customer support. Products from MARIA ÅKERBERG can be sold in a reseller’s web shop six (6) months after first order and six (6) months after completed MÅ Basic Product Training the earliest.


1. Responsibilities for the web shop

The Reseller must assign a specific person to be responsible for selling products from MARIA ÅKERBERG in the Reseller's web shop. This person must be product trained on at least a basic level and must receive newsletters and e-mails from MARIA ÅKERBERG to stay up-to-date. The person must take own initiative to stay in touch with MARIA ÅKERBERG on a regular basis with any changes in personnel, new responsible parties, creating the web shop, updates and assortment. If only parts of the product range are permitted to be sold in the Reseller's web shop, MARIA ÅKERBERG will provide specific notification of such. This is based on the level of training.

In order to be able to sell facial skincare online, a professional Skincare Therapist, Organic Skincare Therapist or person with equivalent training approved by MARIA ÅKERBERG must be assigned to work in close connection to the Reseller's web shop. This person should be available to offer support to the Reseller's Final Consumers.


2. Products

Full information about each Product should be stated in the Reseller's web shop, such as image, price, area of use, how the Product should be used, who it is best suited for, possible contraindications and a full content declaration. Products sold to Final Consumers must have at least six (6) months shelf-life.


3. Updating the web shop 

It is the responsibility of the Reseller to fill in product templates, based on information provided by MARIA ÅKERBERG, as well as to ensure that the web shop, leaflets, catalogues, posters etc. stay up-to-date.


4. Handling payments

The web shop should clearly state what types of payment options are available to the Final Consumer, what these entail in terms of security and what restrictions apply to each payment solution.


5. Total price

The Final Consumer must be able to see in the web shop the total price for an order – including VAT and other taxes, fees and total delivery costs. The reseller must, in close connection with the goods, specify the time during which an offer applies, if the products are in stock and whether they can be delivered according to the stated conditions.


6. Right to assistance and support

The Final Consumer must always contact the Reseller directly for assistance with complaints, withdrawal rights and other assistance relating to the purchase or order. The Reseller is responsible for informing their Final Consumers about this and handling the above without the involvement of MARIA ÅKERBERG. The Reseller must be able to provide support during the specified times stated on the website. Support is provided online, by e-mail or phone and answers should be provided within a reasonable time (normally within 48 hours).


Appendix 1 to General Terms 

A Reseller shall, when it comes to marketing activities with products from and the brand MARIA ÅKERBERG, comply to the following directions and guidelines:

1. The brand MARIA ÅKERBERG shall always be written in capital letters.


2. Logo:

  • The logo consists of the round symbol and the name and cannot be separated. The proportions between the symbol and the name cannot be changed or misrepresented.
  • The background of the logo shall preferably be white or plain but the logo can at times be placed on an image, provided that the image is harmonious and as plain as possible.
  • Together with other information, the logo shall be surrounded by a free zone/space. Within this space, nothing else can be placed.

3. Resellers are encouraged to use images from MARIA ÅKERBERG in their marketing that are available in the image bank at mariaakerberg.se/piwigo/index.php These images are owned by MARIA ÅKERBERG and cannot be edited in any way and filters cannot be applied. The reseller is responsible for current product images being displayed on their website and in their web shop, for marketing and sales purposes.

4. Tester products for all products (where testers are offered) must be clean and tidy and shall not have been opened for longer than (6) months. Tester products can be ordered in the web shop at partner.mariaakerberg.com. “Try MÅ” stickers can also be ordered in the web shop. These are to be placed on the tester products, between the logo and the product name. They shall not be placed on top of text or logo.

5. Products from MARIA ÅKERBERG can only be filled in the company’s bottles with the logo on. No other brand’s products are allowed to be filled in bottles from MARIA ÅKERBERG.

6. New products cannot be marketed as available for purchase prior to the confirmed and communicated launch date.

7. A Reseller cannot sell professional products to Final Consumers (unless MARIA ÅKERBERG has stated otherwise).
